Dear Prime Minister:
As you already know, the International
Court of Justice of The Hague, in its report on the consultation
made to the General Assembly of the United Nations on the construction
of the wall built by Israel, the occupying power of the Occupied
Territories, issued in point D that: All States are under an
obligation not to recognize the illegal situation resulting from
the construction of the wall and not to render aid or assistance
in maintaining the situation created by such construction; all
States parties to the Fourth Geneva Convention relative to the
Protection of Civilian Persons in Time of War of 12 August 1949
have in addition the obligation, while respecting the United
Nations Charter and international law, to ensure compliance by
Israel with international humanitarian law as embodied in that
Convention;
Contrarily, after this statement
was issued by the International Court of Justice and endorsed
by the UN General Assembly, the Israeli Government has ignored
it and continued the construction and expansion of the Wall on
the East of positions considered since 1967 as a part of the
Occupied Territories.
The Israeli Government continues
to expropriate lands, destroy crops and pull up trees owned by
Palestinians. It destroys Palestinian houses, interferes with
communications in Palestinian territory and excludes Palestinians
from housing in Jerusalem, not to mention other acts of violence
and economic pillage, as well as discrimination against its
Arab citizens.
Doing so, it might look that
Israel counts on the explicit or implicit complicity of the United
Nations, the United States, Russia, the European Union and the
members and sponsors of the Road Map.
Thus, we, the organizations
forming the Solidarity Network against the Occupation of Palestine,
consider that the government over which you preside must act
in every diplomatic, political, economic way, or others, in order
to oppose Israeli policies already at work, as the construction
of the Wall.
That is why we ask you, having
stated the Spanish rejection for the construction of the Wall,
as expressed in the General Assembly, and in view of the Israeli
persistence in keeping and expanding the Wall, the settlements
and expropriations, to comply with the ruling issued by the International
Court of Justice.
Besides, as long as the construction
and keeping of the Wall continues, we demand from your government
to implement the dispositions arranged in the Partnership Agreement
between Israel and the European Union, specifically Article no.
2. Accordingly, you must undertake the appropriate legal actions
oriented to this end before the European Council of Ministers
and other European institutions.
Finally, in accordance our
former request, we demand from your government to implement the
appropriate measures so that Spanish relations with Israel will
face the juridical consequences of the construction of the Wall
in Palestinian territory, both bilaterally and in the relations
between this country and the European Union, in application of
the A/Es-10/L.18/Rev. 1 resolution, adopted on July 20, 2004
by the General Assembly of the UN and the ruling by the International
Court of Justice, including the suppression of weapons trade
or exchange.
